"Strafverfahren im Wandel: Mittelbare Beweisführung und Einvernahmeprotokolle"

Das Strafverfahren ist im Wandel begriffen. Die Vereinheitlichung des Prozessrechts in der Schweiz brachte wichtige Neuerungen bezüglich Verteidigungsrechten und stärkte effizienzorientierte Verfahrensformen. Von 2011 bis 2017 untersuchte ein Forschungsteam unter der Leitung von Prof. Dr. iur. Nadja Capus diese Wandlungsprozesse. Der Fokus lag auf der Praxis der Beweisführung und der zunehmend wichtigen Rolle von Einvernahmeprotokollen im Verfahren. Das Projekt wurde vom Schweizerischen Nationalfonds unterstützt und an der Universität Basel durchgeführt.

"The Changing Face of Criminal Procedure : Indirect Procedures of Taking Evidence and Written Records of Interrogations"

The criminal trial is undergoing a process of change. The standardization of the Swiss Criminal Procedure Code in Switzerland has brought important modifications with regard to the enhancement of defense rights and the strengthening of efficiency-oriented proceedings. These changes are analyzed by the research team of Prof. Dr. iur. Nadja Capus in context of the research project "The Changing Face of Criminal Procedure: Indirect Procedures of Taking Evidence and Written Records of Interrogations" which has been approved by the Swiss National Science Foundation (SNSF). The research focus on the practice of evidence and the increasingly important role of the written records of interrogations in criminal trials.

"La procédure pénale en évolution: L'administration indirecte des preuves et procès-verbaux"

La procédure pénale est en pleine transformation. L’uniformisation du droit de la procédure pénale en Suisse mène à d'importantes innovations visées à renforcer les droits de la défense ainsi que les formes de procédure orientés vers l’efficacité.

Cette transformation est analysée par l'équipe de Prof. Nadja Capus dans le cadre du projet du FNS "La procédure pénale en évolution: L'administration indirecte des preuves et procès-verbaux". Cette recherche focalise sur la pratique de l'administration des preuves et le rôle de plus en plus important des procès-verbaux des auditions.
